All rights, obligations, proposals, offers, orders and agreements that fall under these Terms + Conditions, and under this condition, are applicable under Dutch Law and Jurisdiction.

1. General

These conditions apply to all sales and agreements between Beach & Bandits and the consumer, whereby Beach & Bandits will apply these conditions unless agreed otherwise in writing. If products are ordered from Beach & Bandits, the purchaser automatically accepts the stipulations set out in these General Terms and Conditions.

2. Orders

After making an order, the consumer will immediately receive an email confirmation containing the details of the order and the total costs associated with the order, including shipping costs. Custom clearance and/or import/export duties are not included in the price and are the responsibility and on account of the consumer. All orders will be sent to the shipping address within five (5) working days after receipt of payment by the consumer. In the case of technical malfunction, however, which falls under the category of circumstances beyond Beach & Bandits’ control, an order will be shipped as soon as possible. Beach & Bandits will keep the consumer duly informed of the status of the order.We strive to keep our website (www.beachandbandits.com) as current as possible. However, the possibility remains that a certain product is no longer available, in which case we will contact the customer as soon as possible.A product must be delivered to the consumer within 30 days of the order placement. If Beach & Bandits fails to comply with this, the consumer may immediately break the order contract. This is not possible, however, if the parties involved have previously agreed to a different delivery term.Once a consumer’ order has been placed and the consumer has received an order confirmation email, the consumer may not make any changes to the order. If the consumer wishes to make changes to the placed order, or if there is any mistake made in registering consumer contact or address details when placing the order, it is the consumer’s responsibility to contact info@beachandbandits.com immediately.

3. Prices & Payment

All pricing of Beach & Bandits items are in Euro’s and include value added tax. Shipping costs and custom duties are not included in the price. The shipping fees will be added to the order in the checkout step and is based on the weight of the package and its destination. More information concerning the shipping costs can be found on the “shipping” page.  Consumers are able to make payments electronically to Beach & Bandits in many different ways. The differing payment methods are indicated on the website under the title “Payment”.  When ordering products, the consumer will be required to provide payment details, and the consumer represent and warrant that the payment details the customer provide on ordering are both valid and correct. The consumer confirms that the consumer is the person referred to in the billing information provided.  Shipment of the order will take place once Beach & Bandits has received payment for the order. International shipments outside the European Union could have some duties and taxes once the shipment reaches the delivery country. It is the consumer’s responsibility to pay any additional charges for customs clearance. Please note that Beach & Bandits does not have control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order. Please also note that you must comply with all applicable laws and regulations of the country for which the goods are destined. Beach & Bandits will not be liable for any breach by you of any such laws.

4. Shipping

The shipping time is indicative and is therefore not guaranteed. All orders will be processed and shipped to the shipping address within two (2) working days of receiving payment. Beach & Bandits is not responsible for any delays caused by destination customs clearance processes or in case of ‘force majeure’. If a delivery suffers a delay or if the delivery cannot be dispatched or only partially due to the goods not being in stock or other reasons, the consumer will be informed about this as quickly as possible or at the latest 30 days after the order was placed. In this case, the consumer has the right to terminate the agreement, free of charge. Beach & Bandits will refund the consumer with the sum paid as quickly as possible, though at the latest within 30 days after termination. If the package is damaged when it arrives, please contact Beach & Bandits within 24 hours through info@beachandbandits.com and we will contact the shipping company.

5. Transfer of Ownership

Ownership of merchandise will not be transferred until the associated obligations of purchaser have been fulfilled. At the point of transfer of ownership, which is at the point of delivery of the products, product liability is transferred to the purchaser.

6. Money Back Guarantee

If the consumer, for whatever reason, does not wish to retain the product, the consumer has the right to return the product to Beach & Bandits within seven (7) working days after taking delivery of the product. The consumer must first inform Beach & Bandits in writing via email of their intention, and must follow all further return conditions and instructions stipulated by Beach & Bandits on the delivery & return page. Return products are only accepted when the product is unused, unwashed and undamaged. And will only be accepted if they are sent in the original, undamaged packaging and the Beach & Bandits labels or tags still attached to the products. Furthermore, the shipping costs for returned products are on account of the consumer. Under no circumstances will Beach & Bandits reimburse the shipping costs of returned products. If the return instructions have been followed accurately, Beach & Bandits will reimburse the consumer for the returned product(s) within thirty days after receiving it. Beach & Bandits will not accept returns for SALE products. Returns that are damaged or soiled, washed, altered or worn (other than to try the item on) will not be accepted and will be sent back to the consumer. We will charge the consumer for the cost of the return shipping and administrative costs. In the unlikely event that you receive a product which is faulty, please contact us within five (5) working days of delivery of the product explaining clearly the problem found. For faulty products Beach & Bandits will make a full refund to the consumer, including the return shipping, as soon as possible upon receipt of the products and within thirty days, beginning with the date of receipt of the products. Products are faulty if they are received in the wrong style or size – as a result of a mistake made by Beach & Bandits –, damaged or where a manufacturing fault occurs within six (6) months of purchase. Items that are damaged as a result of normal wear and tear are not considered to be faulty. All guarantee obligations lapse if the products are modified by the consumer or any third party, by inexpert use, lack of care or if the consumer does not comply with provided instructions such as washing instructions. If a consumer would like to exchange a faulty product instead of obtaining a refund, the consumer needs to be aware that we can only replace it for the same product in the same size, subject to availability. Where possible, Beach & Bandits will offer to repair faulty products. If it cannot be repaired or the same product is not available, the consumer is entitled a full refund, shipping and return included.

7. Queries/Complaints

In the case of queries or complaints concerning any of our products or procedures, please inform us by email (info@beachandbandits.com). The customer will receive a reply within three working days.

8. Privacy

Beach & Bandits finds it very important to ensure that all of our customer's personal information is treated with the utmost care and security. Beach & Bandits will not give the consumer’s personal information to third parties, except when the information is required for the delivery of the order. When making an order, Beach & Bandits requires the consumer’s name, invoice and delivery addresses, and payment details so that an order can be processed. The payment details will only be used to conclude the payment process. Records of website visits are kept for statistical purposes. Information concerning the amount of visitors and visitor frequency to our website will be used for internal research and website improvement. However, this general information is anonymous and cannot be traced back to the individual visitor.

9. Liability

All products of Beach & Bandits have been produced with the greatest care. Beach & Bandits cannot assume any liability for damages in any form whatsoever, either physical, material or immaterial, that can be caused by malfunctioning or ill use of the products sold by Beach & Bandits and / or materials or accessories becoming undone. The content of the Beach & Bandits website has been compiled with the greatest care. However, Beach & Bandits cannot preclude the possibility of any error or incompletes in the information on this website.  Beach & Bandits cannot assume any liability for the consequences of incorrect or incomplete information on the website. Beach & Bandits cannot be held responsible for any typing or misprinting errors that could communicate an incorrect selling price. In that case Beach & Bandits will adjust the price as soon as possible. All items present in Beach & Bandits are described as accurately as possible. Nevertheless, consumers should read the item's descriptions attentively and if there is any doubt, contact Beach & Bandits at info@beachandbandits.com. Beach & Bandits has taken every measure to provide accurate product images for each product for sale on the website. However, due to the unlimited combinations of screen types, graphics adapters and software settings, it is difficult to ensure you are seeing our products in a true light. Beach & Bandits employs many methods to ensure our on-screen garment colours look as vibrant, rich and as true to life as possible. However, Beach & Bandits cannot be held responsible or liable for any differences in colour between the image and the actual product. Also, the position and size of the actual applications and prints on the products can differ slightly from the display on the website. Beach & Bandits cannot be held responsible for this. If for any reason the consumer is unhappy with Beach & Bandits products, the consumer may simply take advantage of our return service. Certain links on the website can give access to websites and information that is being exploited and maintained by third parties. Beach & Bandits does not control these sites and is not responsible for the availability of these sites. Also, Beach & Bandits is not responsible or liable for the privacy practices or the content of these sites.

10. Force Majeure

Despite any other established legal rights, Beach & Bandits is entitled, at its own choice, in case of force majeure, to cancel your order, or cancel the purchase agreement without judicial intervention, by informing the consumer in writing. Force majeure is understanded to mean any act, event, omission or accident which is beyond reasonable control. The consumer is not entitled to any damages, unless given the circumstances this would be unacceptable according to measures of reason and fairness.

11. Copyright

All information on Beach & Bandits website is protected by copyright. It is illegal to copy, use or distribute Beach & Bandits' website, or any of its content, for any commercial end, nor for any advertising on your own website without first acquiring written permission. Visitors and users of Beach & Bandits website may not claim any rights pertaining to the information on the website. None of the documentation, characters, graphics, logos, design, software images, audio clips and/or video clips from Beach & Bandits websites may be partially or wholly copied or publicly used for printing, photocopying, faxing, overtyping, in an electronic database, or for any other reproduction purposes. The images may not be used for purposes that may seem offensive to Beach & Bandits or the pictured person. Any persons appearing on the images and material has given Beach & Bandits their consent to have their picture used for advertisement and other commercial purposes.

Acceptance of General Conditions

All website users are required to be aware of, and to agree with, all of the above General Conditions. By placing an order with Beach & Bandits, the consumer automatically agrees to all of our General Conditions.
